This privacy statement discloses the privacy practices for Autodata Solutions, Inc., Autodata Solutions, Inc. dba UnityWorks, Autodata Solutions Company, and Autodata, Inc. dba Chrome Data (collectively, “Autodata” or “we” or “us”) in our operation of websites, provision of products and services through mobile and other applications, and software development. Unless otherwise agreed to in writing with Autodata, this privacy statement describes the collection and use of information when you use or interact with our websites, services, and software, (collectively, the “Site”). We understand the sensitivity of any personal information that you disclose to us and are firmly committed to treating such information with the highest degree of care. This privacy statement describes the way in which we handle information received about you during visits to our Site. By using our Site, you expressly consent to our collection, use, disclosure, and retention of your personal information as described in this privacy statement. Each time you use our Site, the current version of this privacy statement will apply. If you do not agree to this privacy statement, please do not use our Site. This privacy statement does not apply to those sites and services that do not display or link to this privacy statement, or that have their own privacy policies.

Collection of information

When you browse Autodata’s Site to learn about our products and our company, you are able to do so anonymously. Our Site uses cookies technology, which means a unique, random number is generated by your browser when you first visit our Site. These cookies do not reveal any personal information about you, but allow us to analyze Site trends and patterns at an aggregate level by gathering the name of your Internet Service Provider (ISP), the website that referred you to us, the pages you request and the date and time of those requests. There are instances where we may ask you to enter personally identifiable information (“PII”) such as your name, street address, phone number, or email address on contact forms in order to fulfill a request or provide you with additional information or customer support. We use this information to identify you in order to determine how to respond to your individual request. This information is normally used to contact you by telephone or email. You will not be contacted if you do not provide any contact information. We do not sell any personally identifiable information to third party organizations. Occasionally, we may use your personal information to contact you to participate in a market research survey that will gauge customer satisfaction and help us develop better products. In addition, we may use your personal information to update you regarding new product announcements, software updates, and other information we think you would find valuable. We may also use information we collect for internal purposes, such as auditing, data analysis, and research to improve our products, services, and communications. Autodata may release your information, including personally identifiable information, when such release is reasonably necessary to comply with the law and otherwise as set forth in this privacy statement.

Autodata is the sole owner of the information collected on our Site.

All information, including PII, collected through our Site is considered a trade secret of Autodata. As the owner of such information, we may disclose or sell such information as an asset of Autodata in conjunction with a merger or sale of Autodata or a portion of our assets to a third party.

Sharing of information with companies or other organizations that are not part of Autodata

Even though Autodata’s Site contains links to other partner and industry resource framed sites (websites operated by another entity whose material is presented in a browser window frame alongside material from our Site), we do not share your personal information with such framed sites. We may share aggregated information about the users of our Site with our partners and third-party advertisers. We partner with other companies to provide specific services (such as fulfilling a request for a quote on a vehicle). When you request these services, we will share your contact information as necessary for the third party to provide such services to you. We ask these third parties to use your contact information only for the purpose of providing the services that you requested.

Once you leave our Site via a link, enable a third-party service, or click an advertisement, you should check the applicable privacy policy of that third-party’s site or service. The fact that we link to a website or present an advertisement is not an endorsement, authorization, or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices.  This privacy statement applies solely to information collected by us on our Site.

Autodata is not responsible for the privacy practices of these partner or resource sites.  In addition, Autodata does not control and has no liability with respect to content which is incorporated from these framed sites.  Use of such content may be subject to other terms and conditions imposed by the operator of such framed sites. Autodata’s privacy statement does not apply to information that may be collected by such third-party sites.

Security provided by Autodata

We take the protection of your PII seriously. We have technical, physical, and administrative security measures in place to protect your information against unauthorized access, disclosure, loss, misuse, and alteration.  Access to all of our users’ PII is restricted to employees and contractors who have a need to know. If you have any questions about the security at our Site, you may send an email to security@autodatasolutions.com. Autodata safeguards the security of the data you send us by using industry-standard Secure Sockets Layer (SSL) encryption and VeriSign® certificates on all web pages where personal information is requested. This protects the confidentiality of any sensitive personal information while it is transmitted over the Internet.

International Users

We are headquartered in Canada and operate our business in Canada and in the United States. Our Site is hosted and administrated in Canada and the United States or hosted with cloud service providers who are headquartered in the United States and are intended for users in Canada and the United States. If you are located outside Canada or the United States, be aware that information you provide to us or that we obtain as a result of your use of our Site may be processed in, transferred to, and stored in Canada and/or the United States and will be subject to the laws in Canada and the United States , as applicable. The privacy and data protection laws of Canada and the United States may be different from the laws of your country of residence.

By using our Site or providing us with your information, you consent to the transfer of your information to Canada and/or the United States for processing and storage.

Disclaimers, Limitation of Liability

Autodata will use reasonable efforts to comply with this privacy statement and will take prompt corrective action when it learns of any failure to comply with its privacy policy. Because of the complex and constantly changing nature of our technology and business, Autodata does not guarantee error-free performance under this privacy statement.

AUTODATA SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, STATUTORY, OR PUNITIVE DAMAGES RELATING TO THIS PRIVACY STATEMENT, EVEN IF WE OR OUR REPRESENTATIVE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Dispute Resolution

We believe we will be able to resolve most disputes or issues you may have using our Site. In the unlikely event we are not able to resolve a dispute or issue, you agree to the following resolution process:

Before initiating any arbitration proceeding, you agree to first discuss the matter informally with us for at least thirty (30) days. To do that, please send your full name and contact information, your concern and your proposed solution by mail to us at: Autodata Solutions Company, Suite 500, 100 Dundas Street, London, ON N6A 5B6 Canada, Attn: Legal Affairs Department.

If we are unable to mutually agree upon a resolution after the 30-day period, you agree that any claim you may have against us will be addressed promptly. To help us do that, you agree to begin any arbitration within one (1) year after your claim arose; otherwise, your claim is waived. As an exception to this arbitration agreement, we are happy to give you the right to pursue in small claims court any claim that is within that court’s jurisdiction as long as you proceed only on an individual basis.

We prefer to resolve our issues with you directly and, accordingly, you agree to arbitrate with us only in your individual capacity, not as a representative or member of a class. As such, your claims may not be joined with any other claims and there will be no authority for any dispute to be arbitrated on a class-action basis or brought by a purported class representative.

You agree that arbitration will be exclusively held in Oakland County, Michigan and that each party will be responsible for its own costs, including paying any administrative and arbitrator fees. In order to select an arbitrator, each party agrees to provide a list of two available arbitrators that have experience with the subject matter. Each party may strike one of the names on the other party’s list. The parties will select an arbitrator out of the remaining two arbitrator names. It is important that you understand that the arbitrator’s decision will be binding and may be entered as a judgment in any court of competent jurisdiction. If you’re not sure what all of this means, of course please feel free to ask an attorney.

Policy Updates

We may change this privacy statement from time to time. If we decide to change this privacy statement, we will post those changes here and modify the “Last Updated” date. Your use of the Site following any such changes will constitute acceptance of the revised privacy statement. However, with respect to our financial institution clients, we will continue to meet our commitments related to sharing of information and security.
